§ 4.50.010. Zone No. 103 (Harmony Hills Subdivision).

    Zone Established. The board of directors of the district hereby establishes a zone of benefit for the Harmony Hills Subdivision, which zone shall be known as "Zone No. 103." Zone No. 103 is established for the purpose of owning, operating and maintaining water production and service facilities previously owned and operated by the owner (the "project"), and for the restoration and rehabilitation of these facilities to meet current standards of public health and safety under the California Safe Drinking Water Act. The zone shall take effect on the effective date of Ord. No. 36, adopted Aug. 27, 2003.

    B.

    Rules and Regulations Established. The rules and regulations for domestic (potable) water service, Zone 103 (Harmony Hills Water System) as contained in Exhibit A attached to Res. No. 2003-08, are established. [Exhibit A is not set out herein, but is available for inspection in the district offices.]

    C.

    Water Rates and Charges. In order to meet the forecasted financial obligations and costs of Zone 103, the rates for water service through the water system of Zone 103 (Harmony Hills Water System) shall be established as follows:

    Residential Service

    Effective June 1, 2009:

    Service and Demand Charge: $192.50 per month

    Energy Surcharge: $24.65 per month

    Total: $217.15 per month

    Effective January 1, 2010:

    Service and Demand Charge: $197.10 per month

    Energy Surcharge: $25.60 per month

    Total: $222.70 per month

    Effective January 1, 2011:

    Service and Demand Charge: $201.90 per month

    Energy Surcharge: $26.65 per month

    Total: $228.55 per month

    The water rates and charges set forth in this subsection shall be based on water service and the amount of water consumed by the customer and are not imposed upon real property or upon a person as an incident of property ownership.

    D.

    Annual Assessment. The district hereby fixes an annual assessment to fund fixed operation, maintenance, repair and replacement costs (OMR&R) and design and funding support for a replacement water system in Zone 103. A schedule of annual assessments and apportionment among the parcels in Zone 103 is set forth in Exhibit A, attached to Ord. No. 36. The assessment shall be effective beginning the tax year 2003—2004.

    The assessment adopted by the district as set forth herein is governed by the provisions of the California Constitution, Article 13D, Section 4. The district board conducted proceedings pursuant thereto and adopted findings regarding the decision to levy an assessment for the Harmony Hills Water System, which findings are attached as Exhibit B to Ord. No. 36.

    The assessment approved herein shall be reviewed annually. Any proceedings to modify the assessment shall comply with the provisions of Article 13D of the California Constitution.
