§ 4.50.030. Zone No. 104 (Fairview Road Subdivision).

A.

Zone Established. The board of directors of the district hereby establishes a zone of benefit for the Fairview Road Subdivision, which zone shall be known as "Zone No. 104." Zone No. 104 is established for the purpose of owning, operating and maintaining water production and service facilities previously owned and operated by the owner (the "project").

B.

Rules and Regulations Established. The rules and regulations for domestic (potable) water service, Zone 104 (Fairview Road Water System) as contained in Exhibit A attached to Res. No. 2004-20, are established. [Exhibit A is not set out herein, but is available for inspection in the district offices.]

C.

Water Rates and Charges.

Established. In order to meet the forecasted financial obligations and costs of Zone 104, the rates for water service through the water system of Zone 104 (Fairview Road Water System) shall be established as follows:

Findings. The Board of Directors hereby finds and determines that:

a.

Revenues derived from the charge imposed herein do not exceed the funds required to pay for operation and maintenance costs associated with Zone 104 (Fairview Road Water System) customers, and shall not be used for any other purpose;

b.

The amount of the charge does not exceed the proportional cost of the service attributable to the parcel;

c.

The service for which the charge is imposed (see 1. above) is actually used by or is immediately available to the owner in question;

d.

The charge is not imposed for general governmental services.
